    In North Carolina, the state determines who is able to make medical decisions, and lists a durable power of attorney as the one to make medical decisions, if there is not a HCPOA or Guardian appointed. A spouse is fourth on the list. So having a durable power of attorney in this state does enable a person to make medical decisions for another person.
